(Applicable to Clients in Ghana & the United States)
These Terms and Conditions (“Agreement”) outline the rules, obligations, and responsibilities that apply when a customer requests financing through installment payments from Trustlink Auto Deals LLC (“the Company”). By signing or submitting a finance request, the client (“Buyer”) acknowledges and agrees to these terms.
1. Eligibility Requirements
To qualify for financing under Trustlink Auto Deals LLC:
1.1 General Requirements (Both Ghana & U.S.)
Buyer must be 18 years or older.
Buyer must present valid government-issued identification.
Buyer must declare truthful information regarding income and ability to pay.
Buyer must agree to a credit, background, or verification check if required.
1.2 Ghana-Specific Requirements
Buyer must provide a valid Ghana Card (or Passport).
Buyer may be required to provide GPS address, employment details, and reference contacts.
1.3 U.S.-Specific Requirements
Buyer must provide a valid State ID/Driver’s License or Visa documentation.
Buyer may be required to submit proof of residence, credit check authorization, and proof of income.
2. Financing Structure
2.1 Installment Breakdown
Financing is offered strictly on an installment payment basis.
Installments are divided into a minimum of Two (2) payments and a maximum of Four (4) payments.
The payment schedule will be agreed upon and documented before the vehicle is released.
2.2 Initial Payment Requirement
Buyer must make a mandatory initial payment (down payment) before the vehicle is secured or released.
The minimum initial payment is typically 25–50% of the vehicle cost (varies based on vehicle, auction rules, and risk assessment).
2.3 Non-Refundable Fees
Certain fees are non-refundable, including but not limited to:
Auction fees
Inspection fees
Administrative or processing fees
Shipping or transportation expenses
3. Payment Terms
3.1 Due Dates
Installment due dates will be clearly stated in the Finance Agreement.
Payments must be made on or before the due date.
3.2 Accepted Payment Methods
Ghana: Bank transfer, Mobile Money, Cash
U.S.: Bank transfer, Zelle, CashApp, Debit/Credit Card
Payments must be made directly to Trustlink Auto Deals LLC and not to any employee personally.
3.3 Late Payment Penalties
If a payment is not completed by the due date:
A late fee may be applied (typically 5–10% of the installment amount).
Continued delay beyond 7 days may result in:
Suspension of financing privileges
Repossession of the vehicle (if already released)
Termination of the agreement
4. Vehicle Release Conditions
4.1 Pre-Release
The vehicle will NOT be released until the agreed initial payment is fully completed.
4.2 Full Ownership Transfer
Ownership documents (title, registration, customs clearance, etc.) will be transferred only after the final installment is fully paid.
Until the final payment is made, the vehicle remains the property of Trustlink Auto Deals LLC.
5. Default & Repossession
A buyer is considered in default if:
They fail to make any installment payment within 7–14 days of the due date,
They provide false information,
They fail to meet verification requirements,
They abandon communication with the company.
5.1 Repossession Rights
Trustlink Auto Deals LLC reserves the right to:
Repossess the vehicle without refund of previous payments,
Charge additional recovery or towing fees,
Report the buyer to relevant authorities (Ghana Police, DMV/Legal authorities in the U.S.).
5.2 Ghana-Specific Enforcement
Repossession will be handled in accordance with Ghana’s Hire Purchase Act and Contract Law.
5.2 U.S.-Specific Enforcement
Repossession will follow state laws relevant to the customer’s jurisdiction (e.g., California repossession laws, Texas statutes).
6. Cancellation & Refund Policy
Buyers may cancel the financing request before bidding or sourcing begins with no penalty (processing fees may apply).
Once the vehicle is purchased or sourced on the buyer’s behalf, no refunds will be issued, except in cases of company error.
Installments paid after vehicle acquisition are non-refundable.
7. Vehicle Condition & Inspection
7.1 Auction Vehicle Disclaimer
Auction vehicles are sold “as-is”, unless otherwise stated.
Trustlink Auto Deals LLC is not responsible for:
Minor wear and tear
Cosmetic imperfections
Post-sale repairs (unless covered specifically by a separate agreement)
7.2 Inspection Availability
Buyers may request:
Pre-auction inspection
Auction report review
Independent mechanic inspection (at the buyer’s cost)
8. Buyer Responsibilities
The buyer agrees to:
Provide truthful and accurate information,
Make payments on time,
Maintain the vehicle (if released before full payment),
Report any issues immediately,
Comply with Ghanaian or U.S. law depending on their jurisdiction.
9. Company Liability
Trustlink Auto Deals LLC is not liable for:
Delays caused by auction houses, customs, shipping companies, or DMV offices,
Changes to auction conditions,
Mechanical issues not covered under warranty (if any).
The company’s total liability shall not exceed the total amount paid by the buyer at the time of a dispute.
10. Governing Law
This Agreement is governed by:
Ghanaian Law for customers residing in Ghana, under:
The Hire Purchase Act
The Sale of Goods Act
The Companies Act
General Contract Law
United States Law for customers in the U.S., based on:
Relevant state contract laws
Consumer protection laws
Vehicle finance and repossession regulations
